Laughlin Case – Donald Capparella achieved success on appeal in a negligent construction case involving Williamson County homeowners. The Court of Appeals dismissed all of the contractor’s claims for damages, and increase the homeowners’ damages for negligent construction, substantially reversing the trail court’s rulings against the homeowners. The Court also reinstated the possibility of personal liability for the contractor. This case could be an important construction law case regarding disputes over payment and construction defects between contractors and homeowners. Forrest Const.
