Roebuck Case – The Court of Appeals reversed a $700,000 final judgment in an auctioneer fiduciary duty case. Capparella successfully argued that the trail court had improperly certified a summary judgment based upon breach of fiduciary duty as a final judgment, returning the matter to the trial court for further proceedings. Brown v. John Roebuck & Associates, Inc., No. M2008-02619-COA-R3-CV, 2009 WL 4878621 (Tenn Ct. App. Dec. 16, 2009).
