Capparella successfully argued that the trail court had improperly certified a summary judgment based upon breach of fiduciary duty as a final judgment, returning the matter to the trial court for further proceedings. Brown v. John Roebuck & Associates, Inc., No. M2008-02619-COA-R3-CV, 2009 WL 4878621 (Tenn Ct. App. Dec. 16, 2009). |
12/9/2009 - Donald Capparella - Laughlin Case - Donald Capparella achieved success on appeal in a negligent construction case involving Williamson County homeowners. The Court of Appeals dismissed all of the contractor’s claims for damages, and increase the homeowners’ damages for negligent construction, substantially reversing the trail court’s rulings against the homeowners. The Court also reinstated the possibility of personal liability for the contractor. This case could be an important construction law case regarding disputes over payment and construction defects between contractors and homeowners. Forrest Const. Salem, Donald obtained a directed verdict in a commercial lease case, where his client successfully defended a breach of lease cause of action. In the second case Johnson v. Gann, Capparella was lead counsel defending an assault and battery tort claim, where the jury awarded only nominal damages in a work-related incident. |

1/31/2007 - Donald Capparella - Donald Capparella and Cynthia Chappell, of Dodson, Parker, & Behm, P.C. won a verdict in the amount of $2,119,541.17 in Davidson County Chancery Court on January 31, 2007. Amy Farrar also assisted. This the result of a three day bench trial, in which Chancellor Claudia Bonnyman found the defendant insurance agents liable for professional negligence, breach of fiduciary duty, negligent misrepresentation and breach of contract in a procurement of life insurance case. The verdict included attorney’s fees and double damages under the Tennessee Consumer Protection Act. |
